Terms of Service

These terms govern your use of Textbackly, operated by Challis Samu (a sole trader based in New Zealand). By signing up for or paying for the service, you agree to them.
1. The service
Textbackly automatically sends a text message to people who call your business when you don’t answer, so you can win back the lead. We connect the service to your existing phone number and help you set up your text templates. Some replies are drafted with AI for you to review and send.
2. Fees
A one-off setup fee of NZ$299 and an ongoing subscription of NZ$99 per month. We are not currently GST-registered, so no GST is added. Payments are processed securely by Stripe.
3. Billing & cancellation
The monthly subscription renews automatically each month until you cancel. There is no lock-in contract — you can cancel anytime, and your service continues until the end of the period you’ve paid for. The setup fee is non-refundable once setup has begun, except as described in the guarantee below.
4. 14-day guarantee
If Textbackly doesn’t catch you a single lead in your first 14 days of being live, you won’t pay the monthly fee for that period. Just let us know.
5. Your responsibilities
- You authorise us to send text messages to your missed callers on your behalf.
- You’ll use the service lawfully and won’t use it to send spam or unlawful content.
- You’re responsible for ensuring the phone number and account details you give us are accurate.
6. No guarantee of results
We provide the tool and do our best to make it work well, but we can’t guarantee a specific number of leads, bookings, or revenue. Results depend on your business and your callers.
7. Availability
We aim for the service to be available at all times, but it relies on third parties such as mobile carriers and our providers, and may occasionally be interrupted.
8. Liability
To the extent permitted by law, our total liability to you is limited to the fees you have paid us in the previous three months. Nothing in these terms limits rights you may have under the New Zealand Consumer Guarantees Act 1993 where it applies.
9. Privacy
We handle personal information as described in our Privacy Policy.
10. Changes
We may update these terms from time to time. We’ll show the latest version here with an updated date.
11. Governing law
These terms are governed by the laws of New Zealand.
